Copyright Information

By entering my name below I confirm, understand, and agree that Tickled Pink Photo/Malea Ellett is the sole Copyright owner of any and all images that may be produced from this photo session and further understand that as the copyright owner- Tickled Pink Photo/ Malea Ellett has the right to use the images (or variations of the images) from this session for publication in advertising materials, websites, blogs, portfolios, displays, or other promotional methods.

Session Agreement

This agreement has been designed so you know exactly what a session with Tickled Pink Photo/ Malea Ellett entails and it helps ensure that I am able to deliver fully to your expectations. Please read all information vigilantly. If you wish, feel free to print a copy for yourself before submitting. If you have any questions, please let me know prior to the session. Photo Sessions

1) Non-refundable SESSION FEE covers my time and talent only. This fee also secures your session date and current prices.

2) Please note, you are responsible for covering additional fees and costs related to location choice (admission fees, parking, etc.). Travel within Washington County is included. Time and travel outside of this area will be invoiced at $30 per hour.

3) I ask that there please be no other cameras allowed at the photo session due to the distraction of the subject/s (especially with younger children). Additional cameras also prevent me from being able to do my job successfully.

4) I would never want to photograph someone who wasn’t feeling their best. If you or your child becomes ill, please contact me as soon as possible to reschedule. I maintain the right and will do my best to reschedule if needed due to inclement weather, illness, emergency, etc.

5) I take no responsibility for you and your child/children’s safety during a session. If I am focusing on one subject I can not be attentive of other subjects that are not in my frame of view. By entering your name below you are confirming that any harm or damage that you or your party may have inflicted/inflict will be at your cost alone and I will not be held responsible. Also please be considerate of the location. I strive to leave each location in the state that it was upon our arrival.

Proofing and Ordering

6) Within 3 weeks after the session—most often sooner--I will post your proofs (20-25) in a password protected online gallery. This gallery will be available for 10 days. Beyond the initial 10 days, the images can be put back up for a $25 per day fee.

7) If your images within your online proofing gallery appear to be either darker or lighter than you had imagined, this may be a monitor calibration issue, please contact me immediately to resolve this issue.

8) Your online proofing images have received my initial proofing enhancements- balancing exposures and ridding of any possible blemishes or flaws. Be sure to view your images carefully. Once you’ve decided on your favorite images to order I will then give those images my final finishing touch similar to those that are displayed on my blog. If you have a request for a small change to an image, please let me know before you place your order. I can attend to minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests (head swapping etc.) are billed on a per project basis. I will advise you if there will be any extra charges before work is begun. Once the requested changes are made, charges apply regardless if the final product is purchased.

9) Please be mindful that I do not place orders or begin design work until payment is complete.

10) Please be prepared to place your order during the 10-day period when your gallery is posted. This is strictly to uphold a speedy work flow and to help prevent backlogging for other clients. Orders may be placed up to 2 weeks from the time you receive your password for your online gallery. Beyond those 2 weeks you will be required to place a $100 minimum order & current pricing applies.

Your Image Disc

11) When ordering a disc I will provide detailed printing instructions along with a copyright release. Your images will be cropped and colored how I believe they will print the best. Some images (particularly those shot in low light) may have visible film grain when enlarged too much. This is normal, but may not be aesthetic. In addition, if you crop an image in too tightly, you will lose resolution and may cause it to be pixilated when enlarged. To ensure the best print quality, try to avoid altering your images before printing. If in doubt, just ask me. I am not responsible for printing errors or for excellence of prints or products not printed directly by me.

Design Work

12) If you purchase items that require design work, I will check with you first to get your input on the images, colors, text, etc. for the design. Try to be as precise as possible. I will then create a design doing my best to integrate your requests.

13) Please keep in mind that there is a great deal of time and planning that goes into all of my design work, so adding, deleting, or moving pictures around can be quite complex and may affect several aspects of the overall design.

Other

14) PayPal is my preferred payment method- it is secure and convenient. If checks are returned by the bank for any reason there will be a $25.00 service charge and sessions/orders will be canceled if they are not paid in full within three days of notification.

15) Tickled Pink Photo retains copyrights on all images (even those purchased on CD) and reserves the right to use the images and/or reproductions for display, publication, or other purposes. (For any major publications or marketing I will contact you first so you are at least aware.) “All rights” pricing is available. Under no circumstances can a client use these images for profit, commercial endeavors, in competitions, or for professional display without my (Malea Ellett) witten consent.

16) Please do not copy images you have not purchased. Copying or scanning images from your gallery, my website, the blog, facebook, or from other printed materials is considered stealing, regardless of the intent for use, and is punishable by law.

17) Credits and special offers are non-transferable and are not redeemable for cash.

18) A new session cannot be scheduled until ordering is complete on a past session.

19) There is no minimum purchase for each individual session but in order to purchase a high/low resolution disk you must have a minimum of a $100 print order.

20) ALL SALES ARE FINAL
